Obama only put unaccompanied minors in detention (which, while terrible is different than what is currently happening). This admin is separating children from parents and putting minors in detention.

Parents are coming to the border and declaring asylum, not crossing illegally, and having their children taken away. (It’s alleged in the affidavits filed in Damus v Nielsen)

It is not a crime to present oneself at the border to claim asylum, in fact it is a requirement to make the claim. And that applies to anywhere on the border.

Once children are separated from parents, they are the responsibility of the Department of Health and Human Services. DHHS has no coordination with ICE to return the children.
