Brett Kavanaugh is Trump’s pick for SCOTUS. A conservative activist who’s been at the center of every conservative cause of the past 20 years, he’ll likely make a mockery of the conservative creed against “activist judges.”

Here’s what we can and can’t do about this. (Thread)

First, let’s be clear on who this guy is. He worked in the Ken Starr investigation, and helped write the Starr Report. He was a key activist during the 2000 FL recount, pushing to end it in favor of Bush. Before Bush appointed him to the bench in 2003, he had had no judicial exp.

Most importantly, Trump’s pick of Kavanaugh serves his needs. In 2009, he argued that the president should be exempted from both criminal prosecution and civil suits while in office, arguing that the latter should be delayed until he leaves the presidency.

Some will argue that he is more moderate because he isn’t extreme enough for the real GOP reptiles. He gave a speech at the Catholic U Law commencement calling for judges to follow precedent. When it came time for action, he failed to live up to that philosophy...

In Garza v. Hargan he sided with cons in a dissent arguing that an undocumented woman held in custody could be denied an abortion by the State. This is a clear violation of the precedent of Roe v. Wade, which held that the state couldn’t restrict a woman’s access to abortion.

Where Kennedy’s conservatism was focused on corporate interests, Kavanaugh will drag the court to the right on social issues Kennedy was the key pivot on, such as abortion, gay rights and healthcare. Abortion is likely to become criminalized in some states. So what can we do?

Kavanaugh worked for the WH under Bush for 5 years. He would have written tens of thousands of emails that are public record. Tell your Senators that they should be published on the Internet as Elena Kagan’s were.

Here is the bitter pill to swallow, the part you don’t want to hear. We are likely to lose. Murkowski and Collins will be bought off, and without their votes, there is no way for Dems to block this appointment, and vulnerable Dems in red states must be allowed to break ranks..

Resist the urge to blame Dems when the inevitable happens. There is no procedure for Dems to block this nomination without 2 GOP votes, and we shouldn’t throw away more seats in the coming election in a pointless sacrifice on the altar of purity. Pragmatism will serve is better.

It’s time to double down on a #2018BlueWave. #BeAVoter! Register new voters! Talk to your friends and family about what is at stake. We lost this because not enough of the left realized our vulnerability with SCOTUS in 2016. We need a Dem Senate to block any future Trump pick.

Tell your Senators to draw blood in the Kavanaugh hearing. Raise your voice in every way possible, there will be countless demonstrations in the coming months.

We should tar every Republican who votes for confirmation as a vote against a woman’s right to chose. Make them pay.

With Dem control in Senate, we can not only shut down future SCOTUS appointments, a precedent set by Mitch McConnell, but halt Trump’s packing of the bench with unqualified demagogues. A Dem majority in the House will provide oversight of Trump’s authority.

THIS IS EVERYTHING.

Our mission has not changed. We knew we would lose big fights in the coming years. We don’t have the luxury to be discouraged, and our fury will make us fight harder.

We will take back Congress in 2018, we will depose Trump in 2020, and we will begin the long clean up.
