in other words, you can get ANYTHING done in india by hiring someone from a small set of millionaire lawyers. and we have to believe it's their brilliant arguments, not that they have social ties with the judges?
there's something deeply disturbing about this scenario.
the FCRA NGO cabal figured this out long ago. for a small investment of a few crores, they can get their missionary #breakingindia sponsors huge force multiplication through the PIL mechanism.
#1 need for judicial reform: force all PILs to be filed in the lowest court, never SC
#2 need for judicial reform: hire more judges, make judges work longer hours, open night courts, no long 'vacations', impose severe penalties for intentional delays and no-shows by lawyers/clients, set strict outer limits (eg 2 years for divorce hearings) that benchmark judges
#3 need for judicial reform: make the selection of judges transparent, fair and open. SC judges may need to be 'confirmed' by voting by a joint session of parliament so that there is a feedback mechanism, and judges are not a nepostic coterie that choose themselves
#4 need for judicial reform: strictly confine the SC to hear constitutional cases. anything else should be referred to lower courts. no grandstanding on cricket or unmarried couples bonking.
#5 need for judicial reform: set up four SC-affiliated regional courts of appeal that will hear anything that exceeds the purview of High Courts. these courts are the final arbiters of anything non-constitutional. SC judges to be rotated through these courts of appeal
important to get these SC judges out of the #lutyens grip by forcing them to rotate through pune, bangalore, chandigarh and guwahati district courts of appeal (to be set up). the baleful lawyer-judge-NGO nexus has to be broken
