#DisclosuresTribunal Patrick Marrinan SC, for the tribunal, has resumed questioning Callinan. Marrinan raises minutes of pre-PAC meetings in Jan 2014 show Sgt McCabe and Ms D were discussed. Callinan says it does appear minutes show 'motivation' was also discussed

#DisclosuresTribunal Marrinan now going through what Deasy told tribunal in a statement and what he said in evidence about chat with Callinan. Specifically Deasy told tribunal that while they were near coffee dock area of Leinster House out of earshot of everyone else...

#DisclosuresTribunal Deasy: "The only part I do remember is him saying that Maurice McCabe was not to be believed or trusted with anything. And the reason I think I remember that is because it surprised me, I have to say." Callinan denies saying this

#DIsclosuresTribunal Deasy also told the tribunal that the alleged comments by Callinan took his breath away. Deasy also said "My opinion..that they [AGS] had lost the narrative by the time they came into the PAC on that Thursday. And they had lost controlled of the events...

#DisclosuresTribunal [cntd] "...and the decision had already really bee made within the committee to allow MM come in. And I think they knew it. it was a kind of a last gasp to actually prevent him [McCabe] from challenging their authority directly."

#DisclosuresTribunal Callinan says he never said McCabe couldn't be trusted and that's the "broad naked reality" Callinan says: '...in adddition to the commentary of Mr Deasy where he expressed the opinion and indicating that his grandfather was a member of AGS...

#DisclosuresTribunal [cntd] '...and would be saddened by a Commissioner making those comments..I would be in exact same position if I said those things...' Callinan says he cannot agreed in "any way shape or form" with Deasy's opinion.

#DisclosuresTribunal Callinan also draws the tribunal's attention to what he said struck him when he looked at the tribunal's materials. He said: This is a man who had possession of that information for quite some time and didn't act.

#DisclosuresTribunal Callinan also points out that Deasy had a conversation with PAC chairman John McGuinness before claiming that Callinan allegedly said what Deasy claims he said

#DisclosuresTribunal Callinan now being asked about the evidence of Comptroller and Auditor General Seamus McCarthy who claims Callinan told him that there were allegations of sex offences against McCabe and that he wasn't to be trusted.

#DIsclosuresTribunal Call concedes he did name Sgt McCabe [McCarthy says this surprised him] but Call says re: the allegation he told McCarthy McCabe couldn't be trusted, Call suggests McCarthy picked him up wrong. C: I do genuinely think there was some kind of misunderstanding

#DIsclosuresTribunal Callinan repeats that he believes Seamus McCarthy picked him up wrong or interpreted what he was saying incorrectly.

#DisclosuresTribunal Callinan says he did tell C&AG McCarthy that there had been allegations made against Sgt McCabe in 2006, that the matter was investigated and that it went to DPP and DPP decided there would be no prosecution.

#DisclosuresTribunal Callinan: "It arose in the context of him indicating that he had heard a story or a rumour that Sgt McCabe was being investigated .."

#DisclosuresTribunal It was McCarthy's evidence to tribunal that Callinan made it clear to McCarthy that sexal offenceS (as in plural) were against Sgt McCabe and "that it was tied very closely to [Callinan's alleged assertion] that he has questions to answer"

#DisclosuresTribunal Callinan tells tribunal: "I never said that Sgt McCabe had sex offences against him because as far as I was concerned the only allegation that I had known about was the 2006 allegaiton and that has long since been dealt with."

#DisclosuresTribunal Callinan seems to be referring to the fake rape allegation circulated in August 2013. (NOTE: It's also been Dave Taylor's evidence that he also didn't know anything about this fake Tusla referral)

#DisclosuresTribunal It's been Seamus McCarthy's evidence that the Ms D/2006/DPP details weren't put to him. McC told trib: "I was certainly not aware of any allegations from 2006 or the involvement of the DPP.The sense I had was that it was a matter currently being investigated"

#DisclosuresTribunal Callinan denies saying what McGuinness claims he said and Callinan says, after the PAC meeting in Jan 2014 (when alleged comments were made) he asked McG if John Wilson would be giving evidence and McG said: "You must be joking, sure he's an f-ing header"

#DisclosuresTribunal Callinan tells tribunal that, at this time, he was aware of former Garda John Wilson's nickname "Jockey Wilson" but he wasn't aware of why he was called that. Callinan says he thought he was named that after a darts player (Callinan said this last Fri too)

#DisclosuresTribunal Call repeats he didn't know 1980s story of Wilson seizing a horse from a Traveller on Grafton Street and riding it to Pearse Street Garda stn (where they were both working at the time, when Call was a sergeant..Call says there were 130/40 gardai back then)

#DisclosuresTribunal This was McGuinness's evidence. Marrinan puts to Callinan that, independently of each other, Mr McGuinness, Mr Deasy and Mr McCarthy also say Callinan allegedly blackened Sgt McCabe's name

#DisclosuresTribunal Marrinan points out he did publicly use word "disgusting". Call concedes "it was a strong word" but says he was referring to the manner in which the w/blowers were bringing matters to fore. Callinan said he had no difficulty with them reporting wrongdoing

#DisclosuresTribunal Callinan claims McGuinness has said things that aren't correct. He points out McG told RTE he took no notes of the carpark meeting and then produced notes of the meeting to the tribunal

#DisclosuresTribunal Callinan: "I never in any way, shape or form spoke about Sgt McCabe in a dergotary fashion at all when we [him and McGuinness] had our conversation on 24th January, 2014"

#DisclosuresTribunal Marrinan points out his evidence is at odds with FG TD John Deasy, FF TD John McGuinness, G&AG Seamus McCarthy, RTE's Philip Boucher Hayes and solicitor Gerald Kean (Kean claims Callinan told him not reveal him as his source of info for @MarianRTE )

#DisclosuresTribunal Marrinan puts to Callinan that they're all independent of each other. Marrinan asks Callinan if he can identify a link between them. Callinan says there's a certain amount of commonality in how they interact with one another

#DisclosuresTribunal Callinan adds it would be non-sensical to suggest that there wasn't some form of discussion ahead of Sgt McCabe's appearance before PAC

#DisclosuresTribunal Marrinan now referring to the carpak meeting between him and McGuinness in Jan 2014 (day after PAC meeting). Tribunal has already heard Call had allegedly drafted a letter for McGuinness which was never sent - as he met McGuinness in the carpark instead

#DisclosuresTribunal has already heard that it's Callinan's evidence that what they discussed on that Friday (Jan 24) was the contents of this draft - as opposed to what McGuinness claims (which was that Sgt McCabe abused his children and nieces)

#DisclosuresTribunal As previously stated this letter was never sent. Marrinan points out the letter states: "Firstly I wish to thank the committee for affording me the opportunity yesterday the 23rd Jan 2014..." and "As I indicated to the committee today I was satisfied..."

#DisclosuresTribunal Callinan says of this letter: "My belief is that this letter was prepared on the 23rd and I had it on the 24th and I sought a meeting with McGuinness on that basis..these were the proposals I intended to put to him."

#DIsclosuresTribunal Callinan says: I suggested that we meet at the [Bewley's Hotel] carpark simply to expedite his [McGuinness] journey home...he [McG] was under time pressure. Callinan says there was nothing sinister about it.

#DisclosureTribunal Callinan says he walked less than 50/75m to McGUinness's car and that when he approached his car, McG moved papers from his front passenger seat and he took that as an indication to sit into McGuinness's car. Callinan didn't have the draft letter with him

#DisclosuresTribunal This is McGuinness's evidence of the carpark meeting.

#DisclosuresTribunal Of the claim that Callinan said McCabe "sexually abused his family and an individual: Callinan: "That is absolutely false. I never under any circumstances said anything of that nature"

#DisclosuresTribunal Callinan says it's "completely and utterly false" that he told McGuinness that he [McG] would find himself in serious trouble over bringing McCabe into PAC

#DisclosuresTirbunal Of claim that Callinan led McG to believe there were allegationS [plural] and that Sgt McC would be charged, Callinan says the allegation is "Totally untrue chairman and would be contrary to any facts that I had in my knowledge at the time."

#DisclosuresTribunal [cntd] Callinan: "I wasn't aware of any investigation or inquiries at all in relation to Sgt McCabe". Callinan also says it was McGuinness who asked him about the Ms D allegation and if it was that which was behind his complaints.

#DisclosuresTribunal Marrinan points out it's been McGuinness's evidence the matter about data protection (what was in Callinan's draft letter and what Call claims they discussed) was already dealt with at this point.

#DisclosuresTribunal (Trib has seen corr to that effect back and forth btw Call and McG in Dec '13 and Jan '14)

#DisclosuresTribunal Callinan again claims that it was McGuinness who raised the Ms D investigation and asked Callinan if this was behind Sgt McCabe's complaints. Callinan says that McGuinness indicated to him that he knew all about the criminal investigation.

#DisclosuresTribunal Callinan repeats: "I didn't at any point try to undermine the work of the Public Accounts Committee or speak in derogatory terms of Sgt McCabe nor would I."

#DisclosuresTribuanl Marrinan asks Callinan again why did he meet McG on this Friday, January 24, 2014. Callinan says that at that point in time it wasn't decided if McCabe would appear in PAC in public or private. He said the urgency was to find out if this was a runner

#DisclosuresTribunal Marrinan says he shook McGuinness's hand after their chat and asked him to keep him informed as to whether McCabe was to appear in public or private - as opposed to the claim Callinan grabbed his arm as he left the car and told him 'this is very serious'

#DisclosuresTribunal Marrinan puts to Callinan that as of close of business on 23rd Jan 2014 (day of Callinan's PAC appearance) his efforts didn't bear any fruit in relation to issue of whether or not McCabe would give evidence to PAC.

#DisclosuresTribunal Marrinan: "If one accepts McGuinness's account, it [carpark emeting] would appear to be a last-ditch effort by you to try and turn the commitee against Sgt McCabe and that that might resolve the issue favourably as far as you were concerned"

#DisclosuresTribunal Callinan says he finds it unusual that he appeared before the committee (bear in mind he had his chat with Mr Deasy BEFORE the PAC meeting began) and the claims weren't put to him there. C: I find that quite extraordinary

#DisclosuresTribunal Call says of McG's note of the carpark meeting: "I cannot accept that that note is an accurate note" Callinan suggests there's an amount of "fuzziness" around a serious matter. Repeats the RTE News comment where McG said he didn't make a note of the meeting

#DisclosuresTribunal Marr again points out the no. of allegations against him. C said "outrageously serious allegations are being made against me" Says for life of him he can't understand. C:'They're not true in any way shape or form...they're simply not true, they're falsehoods'

#DisclosuresTribunal Callinan: I can only give you my version.... I'm telling the truth, I'm hear to tell the truth and that's it.

#DisclosuresTribunal Marrinan now going to Supt Dave Taylor's protected disclosure. Goes to bit where Taylor claims he was instructed by Callinan to brief media negatively about Sgt McCabe - to effect that the was "driven by agendas"

#DisclosuresTribunal Callinan says it's "absolutely not the case" that Taylor was instructed by him to brief media that Sgt McCAbe was motivated by maliciousness and revenge

#DisclosuresTribunal Marrinan Did you think he [Taylor] had a close relationship with a number of journalists. Callinan first off started saying you have to separate now what you knew then..but eventually concedes: No, not particularly..

#DisclosuresTribunal has already heard the first journalist to contact D family in early 2014 was Debbie McCann of the IMOS. Taylor has told tribunal that McCann told him beforehand that she was going there and then, after the visit, that she told him she didn't get an i/view

#DisclosuresTribunal [Tribunal has also heard it's the evidence of McCann's colleague Alison O'Reilly that McCann told her [AOR] that Taylor told McCann that Ms D "was in a bad way". Marrinan asks Callinan if Taylor advised him of these contacts, Callinan: "No".

#DisclosuresTribunal Callinan says most queries about Sgt McCabe were brought to his attention and conceders the expectation would have been that Taylor WOULD have told him about those communications. Asked if he has any reason for why Taylor didn't tell him, Callinan: "No"

#DisclosuresTribunal Marrinan puts to Callinan that, in normal run of things, it would be something that Callinan would be updated on. Callinan agrees.

#DisclosuresTribunal Callinan agrees that he's surprised Taylor didn't inform him

#DisclosuresTribunal Callinan agrees that Supt Taylor also didn't tell him about the Irish Sun's Eavan Murray either (it's been Taylor's evidence that he neg briefed EM and that she also told him before she - separately - visited the house after McCann)

#DisclosuresTribunal Tribunal has already heard that it's been evidence of Paul Williams (who was only journalist to write about Ms D in early 2014) and Mr D that PW interviewed Ms D after he was introduced to Mr D via Supt John O'Reilly. Asked if he knew of this contact, C: No.

#DisclosuresTribunal It's also been Taylor's evidence that PW contacted him on a Saturday and that he said "guess where I am?" before saying he was going to write a neg article about McCabe (PW denies this). Trib has heard he interviewed Ms D at her house on Sat, March 8, 2014

#DisclosuresTribunal Marrinan asks Callinan if he had been told about this alleged phone call [which PW denies], Callinan: "No, no chairman." Callinan says he would have "certainly" been interested to know about such contact btw PW and Taylor.

#DisclosuresTribunal Marrinan: If it happened Paul William did contact Supt Taylor on March 8 you would have expected him to update you? Callinan: I certainly would chair, yes.

#DisclosuresTribunal Marrinan puts to Callinan that Supt Taylor did text Callinan on Saturday March 8. Callinan: I don't dispute that. Marrinan says Taylor also texted Noirin O'Sullivan at the same time and, immediately after, there was a communication btw him and McCann

#DisclosuresTribunal [cntd] Marrinan points out that AGS director of comms Andrew McLindon [whom Taylor alleges was also aware of alleged campaign which McL denies] was also contacted around that time. Asked if he had any recollection of texts at that time, C: No.

#DisclosuresTribunal When Taylor gave evidence about his call to McCann on eve of Sat, March 8, he was asked "were you ringing her [McCann] to tell her that Mr Williams had scooped the pool perhaps?" and Taylor had replied: "Absolutely not."

#DisclosuresTribunal Marrinan now reading out Taylor's PD in which he claimed he was told to neg speak of McCabe but also to tell ppl McCabe didn't cooperate with John O'Mahony investigation [NOTE: This was claim made by Gerald Kean on @MarianRTE show after speaking to Callinan]

#DisclosuresTribunal Now hearing of statement made by McCabe on Feb 24 2014 in which he said it wasn't true he was written to and told to cooperate with JOM probe into penalty points. In his statement McCabe refers to an earlier AGS statement which had been sent out about him

#DisclosuresTribunal In his statement, McCabe said the AGS statement implied he wrongfully failed to comply with Commissioner's instructions to cooperate with JOM. Callinan says he's looked for this AGS statement and hasn't been able to find it.

#DisclosuresTribunal Tribunal hears the AGS press release was reported on by RTE journalist Paul Reynolds on the 2pm news that day (which was a Monday).

#DisclosuresTribunal [NOTE, McCabe subsequently gave a statement to refute the AGS statement/Reynolds report to Katie Hannon for Prime Time the evening of that same day (Feb 24 2014).]

#DisclosuresTribunal Marrinan now going to C's phones. Tribunal has already heard a phone he gave to Fennelly Commission which was used during relevant time period (when Supt Taylor was in press office) - has been given to the tribunal

#DisclosuresTribunal Asked if he deleted texts, C said he prob would have to make room but he didn't delete anything of importance to the trib. ( Tribunal has already heard 277 of 278 texts were deleted)

#DisclosuresTribunal C: When I was asked for the phone, I searched for it, I found it, brought it over to Fennelly with the charger, I didn't switch it on, I didn't delete any messages. Callinan asks Marrinan is it certain that 277 messages were deleted? (this is clarified)

#DisclosuresTribunal Texts read out to tribunal. NOTE: Tribunal has already heard that while forensic experts were able to recover deleted texts they couldn't recover details of who sent and received the texts so sender/recipent not noted.

#DIsclosuresTribunal McDowell, for Sgt McCabe is now questioning Callinan. McDowell raises a document about Sgt McCabe and Ms D matter which was created in 2013 and tribunal has already heard was on Commissioner's File Share System

#DisclosuresTribunal has already heard Callinan (last Friday) say he's never seen this document. But tribunal has also heard it was in pack of documents prepared of pre-PAC meetings in January 2014 (ahead of his appearance before PAC).

#DisclosuresTribunal Trib has already heard doc seems to have been created in June 2013 (it lists matters pertaining to McCabe going back to '92). McDowell asking why would such a doc be created. Suggests someone spent a lot of time to uncover anything discreditable about him.

#DisclosuresTribunal Callinan says it seems to be a summary of incidents but he can't shed any light as to why it was created. [NOTE: The fake rape allegation re: McCabe, came about in July/Aug 2013]

#DisclosuresTribunal McDowell now going through the extensive document which is a complete synopsis of matters pertaining to McCabe including an allegation that a guard heard of a threat to shoot Sgt McCabe in January 2011

#DisclosuresTribunal McDowell asks who would have ordered such "a compendium of bad news" about Sgt McCabe. Callinan says he doesn't know.

#DisclosuresTribunal McDowell says it was Supt Frank Walsh who compiled the document. [Supt Frank Walsh was Callinan's private secretary until he stood down and then he became private sec to NOS]. Callinan accepts FW compiled it but says he can't recall it.

#DisclosuresTribunal McDowell refers to a circular sent around by Chief Supt Colm Rooney in 2011 congratulating all gardaí in Bailieboro, Co Cavan saying the Byrne/McGinn report vindicated the station's high standards was a "cruel put down" against McCabe

#DisclosuresTribunal Rooney apologised to Sgt McCabe for sending this letter earlier this year in the tribunal. McDowell says the designed effect of the circular was to humiliate McCabe. Callinan: I don't believe it was an appropriate letter to be sent."

#DisclosuresTribunal Callinan repeats that he has/had no problem in wide earthly world with McCabe making complaints which he saw fit to make

#DisclosuresTribunal Sees that on 9/1/2013 Asst Comm Derek Byrne emailed Asst Comm John O'Mahoney with subject line 'contact. Email says: "John, A number of phone calls were received at my office over the past few days from a Mr Bernard McCabe..."

#DisclosuresTribunal "....I made phone contact with Mr McCabe who reported that he is an uncle of the whistbleblower (his words) and that he has a lot of infomaiton about him and wishes to meet with a member of AGS to pass on the information..."

#DisclosuresTribunal [cntd]..."I informed Mr McCabe that I was not the appropriate person to speak to him as you had been appointed by the Commissioner to investigate issues rasied by the whistleblower. I informed Mr McCabe that I would pass on his details to you.."

#DisclosuresTribunal [cntd] "...and that you would arrange contact with him." Tribunal hears, in response, John O'Mahoney writes the following morning to head of the NBCI Padraig Kennedy saying...

#DisclosuresTribunal "Further to our telephone conversation this am please find attached from AC Byrne. You should make contact with Mr McCabe and listen to what he has to offer. Report in course. Regards, JOM"

#DisclosuresTribunal Tribunal hears Det Supt George Kyne and then head of NBCI Padraig Kennedy went to Sgt McCabe's uncle house and the uncle and his son alleged that 2 people arrested for drink driving had cases withdrawn due to interference by Sgt McCabe

#DisclosuresTribunal Tribunal hears this meeting took place in 2013. Turns out the first person had no criminal record and, other than being a victim of a burglary, there was nothing on PULSE about him. Re: Second person - he had been convicted of drink driving.

#DisclosuresTribunal McDowell says the matter was "utterly bogus". Charleton has said he's read the documents and says he's read them with "an increased state of puzzlement, verging on bemusement and tipping over into...." Mentions drugs, goats and cattle

#DisclosuresTribunal McD says McC never knew about this matter until tribunal papers showed it took place. McD: He's [McCabe] the man who's always left in the dark..." McD recalls how a file sat on NOS desk accusing him of rape since May 14 and he wasn't told of it until Jan 2016

#DisclosuresTribunal Tribunal hears that in January 2017 another guard met with Sgt McCabe's uncle for two hours in which he made false assertions that Sgt McCabe was influential in getting people off with road traffic offences going back 15 years.

#DisclosuresTribunal hears the guard reported that Bernard McCabe wanted the AGS to investigate Sgt McCabe but he had no material to support his assertions. The guard told Ber McC to contact him again if he had more specific information

#DIsclosuresTribunal McD now recalls evidence of Sgt Molloy who is only Garda press officer who said there would have been chat about McC. Molloy also said Taylor was "uncomplimentary" about McCabe, any journs in favour of McCabe and any Oireachtas member who took McCabe's side

#DisclosuresTribunal Call says he's no recollection of Taylor being like this about McCabe. McD says he's "a bit mystified why 1 press officer would sense this hostility and you'd never have experienced it". Call says there's a lot he's learned about Taylor via tribunal evidence

#DisclosuresTribunal hears that in notes that Callinan took at one of the pre-PAC meetings it says 'Did we investigate: "what that man wants is a bullet in the head" '- with the inverted commas around that quote.
