2/ the emoluments Lawsuit, even if successful may have no tangible effect on Trump profiting from the Presidency - and there would be no accountability for corruption, the clause and lawsuit merely address a conflict of interest. 👉
3/ The means to hold Trump accountable for corruptly profiting from the Presidency (for the same acts as under the Emoluments Suit) is prosecution under 18 USC 201 (b) and (c): the Federal Bribery Law. This law provides criminal penalties for accepting gifts for official acts 👉
4/ Under 201(c), there doesn’t need to be a quid pro quo agreement (bribe); if Trump merely knows of anything of value given to him for an official act (even if it’s just a “thank you” gift after the fact), the penalty is two years in prison 👉
5/ And violation of 18 USC 201 is one of the express grounds for impeachment under Article II of the Constitution (Bribery). So rather than risk so much on Emoluments suits, petition the DoJ to prosecute under 18 USC 201. #Corruption #Emoluments #Trump

Why do journalists keep taking Trump at his word and Report his version of reality as fact, even though he is known (and widely reported by journalists) to consistently lie? 👉 1/ mobile.reuters.com/article/amp/id…
2/ In this Reuters “Exclusive”, it is reported as fact that Trump “worries” an interview w Mueller would be a “perjury trap”, with no evidence provided to back the assertion. Perhaps Trump in fact knows that either a) he would lie or b) tell the truth and incriminate himself. 👉
3/ Or perhaps, Trump spoke his true belief. But, if Trump’s true concern is that he will be entrapped, and not that he knows telling the truth wld be incriminating, it would indicate his innocence. Thus, whether Trump’s assertion is true has great importance. And yet ... 👉

2/ The likely crime, if there is one, would be Conspiracy Against the US or Conspiracy to Defraud the US: Crimes which Mueller has already brought against Russian Intel, Manafort and other Trump associates. 👉
In order to be guilty of a conspiracy, there must be an Agreement among two or more persons to commit a crime. The people don’t need to know the identity of (all of) the co-conspirators, but they have to intend to agree to the crime 👉

2/ By depicting Butin’s support for Trump and the NRA (of which she is a lifetime member), as a “ruse”, the Times depicts Trump and the NRA as unwitting dupes in a Russian Intel operation. But this, taken as fact, is unsupported in the article. If Trump/NRA ... 👉
3/ actively aligned w the Russians (as is being investigated) it would be if significant consequence (of course); and yet the Times assumes and reports as if this is not the case (as fact); thereby giving legitimacy to Trump and the NRA without evidence to do so. 👉

Trump’s backpedaling on his Helsinki remarks tells us two important things about Trump’s position: Trump’s political power has limits even within the GOP, and his political power is greater than his governmental power at present 👉 1/ Thread
2/ Trump’s political position, 90% approval among GOP voters, many or most of whom adopt his positions as their own whether or not they previously held the positions and w great personal loyalty to Trump, is strong. He has an intuitive understanding of them and political power.👉
3/ Trump’s governmental position is weaker: he is constrained by Separation of Powers; many of the Congressional GOP give cultish support but others do not always give unquestioned support: many grumble + disagree in private but support him publicly to enact their own agenda 👉

Trump has made undeniably clear this week that as President he is: 1) opposed to and in conflict w liberal democracies; 2) aligned ideologically and politically w Putin, Erdogan + illiberal and autocratic regimes.The Press, Congress, etc can longer call it mere rhetoric 👉 Thread
2/ Trump stated unequivocally that he sees the EU as a foe; trusts Putin over US intel services; seeks an alliance w Russia (at least in key global matters); and holds democratic leaders in contempt (Merkel, etc). His agenda is illiberal and breaks w all modern US precedent 👉
Yet, He doesn’t have firm control of the US government, yet.Factions in his administration, in Congress, Civil Society (on right and left) and the majority of the public does not share his agenda and many are actively or passively opposed to it. The clearest example of this... 👉
