{thread} On Sept 28th, CIG filed their opposition to CryTek’s second amended complaint. I haven’t covered it because they have a hearing coming up on Oct 10th in front of the judge, and I was going to wait and cover them both in a single article.

docdroid.net/gyyGc4q/031129… Also, as per the judge’s previous instructions, both parties got together and finally filed a Rule 26(f) discovery report/plan. Much to the chagrin of CIG of course, since they've been fighting to avoid discovery since January this year.

As if there was any doubt, the Starflight 3 campaign was a complete and utter train wreck.

I said it wouldn't fund.

22 years ago today, my first game, Battlecruiser 3000AD (BC3K) was released.

The History.

threadreaderapp.com/thread/1046776… I also remember how Take 2 tried to shape the narrative and pin the blame on me. Claiming that I was mad at them over the game, kicked a coke machine, and quit the development.

And CGW, without a SINGLE effort to fact check, printed it.

And another BC3K meme was born.

{thread} Today, 22 years ago, after a very long, challenging, and arduous journey fraught with disappointment and betrayal, I became a part of videogame history.

My first game, BATTLECRUISER 3000AD (BC3K) was commercially released by its then publisher. Back then, marketing promos were focused on print media advertising, shows (E3, GDC etc) as well as extortionate shenanigans by the top retailers who made publishers pay a premium for end cap space in order to sell games in stores. Especially during Christmas holiday season.

{thread} The Mandate, a space combat game which I backed in 2013 and which raised $700K via @kickstarter and which raised $700K - is dead.

According to sources, it was an absolute scam.

kickstarter.com/projects/19644… @kickstarter Perihelion Interactive was formed in Luxembourg solely for this project.

It was formed by Matus Kirchmeyer, a Slovakian businessman and former programmer. He is also head of Matsuko (a VR/AR co that does corporate promos)

I have been watching her testimony. It's so absolutely heartbreaking that words simply cannot express it.

msnbc.com/now She turned out to be absolutely credible. This was a complete disaster for the sham that the GOP are engaged in.

Over the decades I have amassed a following of fans (and a few loons) of my works & unabashed rhetoric. So when Trump became POTUS, me being the rebellious type, joining the resistance (for a good cause this time - honest!) was a no-brainer. Thing is, it is so easy to fall into the trap of being "too political" when you engage in discourse that not only interests you, but which also move you to publicly express an opinion (regardless of merit, veracity or anything meaningful) that's likely to wind up people.

Well, in the "Derek Smart Was Right" dept, comes yet more bad news for Star Citizen backers (most of whom have already given up at this point).

Oh where to start?

OK, lets start with a blatant trolling effort because, well, this stuff is never not funny... So, you remember some weeks ago when Chris tried to paywall the public live stream of the upcoming CitizenCon event? Sure you do because, well there was quite a furor over it, complete with media trolling. Then they reversed course. All this happened in less than 24 hrs.

So it doesn't look like Starflight 3 is getting funded.

I'm completely shocked that endorsements from big "names" who have NEVER worked on ANY games in the genre didn't help. Shocking.

Lackluster pitch and near-zero updates haven't helped either.

fig.co/campaigns/star… Both SF 1&2 was my inspirations and heavily influenced my decision to start making games. And of course I headed straight into sci-fi.

Star Fleet, Sentinel Worlds, Hard Nova etc - all classics and major influences.

I was conflicted about posting this latest Star Citizen bit because I tend to shy away from anything that has anything to do with people losing their jobs. But this is Star Citizen and they're all knowingly working on an active scam, so all bets are off. At 6:15am I woke up to an alarming secure message from one of my top sources (who is sadly leaving). It was rather long, but the gist of it is that the general consensus is that the project is doomed, they ALL know it.

I have to admit, when it comes to this industry's many shenanigans, I love that I am still around to see that I continue to be right about certain things. In 2009, I wrote an article on @gamasutra about where @steam_games was headed.

gamasutra.com/blogs/DerekSma… @draginol (in the comments) and I go way - way - back (all the way to Usenet and my OS/2 days in fact). As peers & devs of sci-fi games, over the years we've argued & disagreed about so many things. And this was just one of many.

BREAKING! CIG have filed a new MtD in the lawsuit. This comes after the judge threw out 4/6 items in the original MtD. Crytek later filed a new cause of action over a section pointed by the judge in her 08/14 ruling.

ICYMI: There was yet another Star Citizen fiasco which, unlike others before it, was squelched within 12 hrs due to a massive outpouring of lols.

My thoughts.

dereksmart.com/forums/reply/6…

Also, @Charlie_L_Hall is writing about Star Citizen again. Yay!

polygon.com/2018/8/31/1780… It's all about money.

Once again, he planned something that he blew the budget on.

Then he tried to get backers to pay for the excess.

That's all there is to it.

So the latest Star Citizen fiasco dropped last night - and it's going to be an AMAZING holiday weekend for the lols.

Let's roll.

BREAKING NEWS!!

It appears as if CIG have finally reached the limits of hilarity.

The October CitizenCon is going to be paywalled.

I have reached out to my sources for confirmation because I simply don't believe they're this desperate for money. Wow. reddit.com/r/starcitizen/… Unlike previous years, they've had a hard time selling tickets this year. And the venue is going to set them back a cool $1M+. So unable to sell tickets, if true, this is their way of forcing backers to pay to watch the event if not attending.

A very good article which mirrors some of my own observations in the lengthy FB write-up I did on the day it was released. Most of us devs have already written it off now. It's almost as if the top tier devs working on it, were on a paid vacation. Us game devs are finicky, fair weather crybabies. You only get ONE chance to get us on board with ANYTHING. And if it's hw related, good luck with that because one mistake, and we get to completely, and without remorse, bury it. Without our apps, your hw is DOA. Period.

BREAKING! CIG have filed their response to the latest SAC filed by CryTek.

docdroid.net/N0hyv2e/031128…

I took a quick look; and will delve into it briefly now. TL;DR

Dec 2017: CryTek sues CIG/RSI for a litany of things which all but guarantee to put them out of business

Jan 2018: CIG answers suit, and files a Motion To Dismiss (MtD) all of it

Aug 2018: Judge rules on the MtD

Robert Marks weighs in on the latest Crytek v CIG debacle

cgmagonline.com/2018/08/17/cry…

via @CGMagonline @CGMagonline I don't think Robert read the GLA. If he did, he would have noticed that 2.4 and 8.x are major problems because when connected, they both are very damaging.

He also made a mistake about the judge saying she won't allow 2.4 in any responsive replies. She didn't say that.

BREAKING! Crytek have now filed a second amended complaint that solidifies their claims.

They specifically went for what I wrote that they would as per 2.4.

It's funny - and I'm not even a lawyer.

I will have more in a bit.

docdroid.net/X4V4AC9/031128… ICYMI. My previous coverage was converted into an article, and also now includes info about their latest financial filing in the UK.

BREAKING NEWS!! As I had predicted back in Jan this year, the judge has DENIED the MtD in the CryTek v CIG case.

More soon.

pacermonitor.com/public/case/23… I can't WAIT to read what all those Star Citizen YT lawyers (who shockingly have law degrees) have to say now. Anything that doesn't amount to the usual "Derek Smart Was Right", should be disregarded out of hand.
