UCC had opportunity to comment on the #Data.Protection & Privacy Bill. The enactment of this law is long overdue. A comprehensive law on the collection & processing personal information gives effect to the right to Privacy envisaged under Article 27(2) of the Constitution
UCC welcome the protections offered by the Bill in terms of export of data, breach notification requirements, data subjects access rights, automated decision making, compensation and the right to be forgotten and provision for financial and penal sanctions for breach of the law.
Distinction between Data collectors & data controllers.
The Bill should however clarify & distinguish Data Collectors, from Data Processors & Data Controllers. Clause 2 is inconsistent with international good practice which provides for two broad categories of Data Controllers

1. You mentioned the premise of the report is to unlock the data economy while keeping data of citizens secure and protected. Basically ensure public good plus protect informational privacy. Was this balance all the more needed for a developing economy like India?
2. While you have defined consent, consent is only one of the grounds for processing of personal data. There is provision that allows processing for reasonable purposes,especially allowing the state to process data. Does this give the govt overarching power?

How can the state violate our privacy? Let me count the ways
1. Processing of personal data in the interests of security of the state
(Our current surveillance laws would keep the stasi perfectly happy)
2. For the 'prevention' of offences and contraventions of law.
( Remember sedition is a criminal offence)

It is not just the Data Sharing Bill, but the Data Sharing And Governance Bill.

The Governance part, one might have thought, is covered by the GDPR & DPAs. But no, it creates a shadow system.
The scope of "public bodies" covered is eye-watering: ministers, Revenue, Gardaí, Defence Forces, E&TBs, schools, bodies partly funded by Gov, subsidiaries ...

At the outset of the #Brexit process, most people assumed that a deal on #police and #judicial co-operation was easier to get than one on #trade. Time has shown this is not the case. Ongoing co-op on #JHA is one of the few items yet to be agreed on #withdrawal deal. Why?
Well, because the #EU and #UK's opening positions in the #negotiation are incompatible: Britain wants a #bespoke agreement with the EU, a la #Schengen, but is not willing to accept #ECJ or #EUCharter. EU wants to replicate existing models. What to do?
